Ben Rose is a Litigation Partner at Adam Leitman Bailey P.C. in New York, New York. His practice focuses on Commercial Litigation, representing clients in complex disputes involving contracts, securities, bankruptcy, real estate, partnership matters, white collar criminal defense, and regulatory investigations. With more than fifteen years of litigation and trial experience, Mr. Rose has handled matters in state and federal courts, arbitration proceedings, and government investigations across a broad range of industries.
Before joining Adam Leitman Bailey P.C., Mr. Rose practiced at White & Case LLP in the firm’s Commercial Litigation Group. During that time, he represented Major League Baseball in the Los Angeles Dodgers bankruptcy proceedings, defended a Wall Street trader accused of participating in an alleged fraudulent trading scheme involving claimed damages exceeding $500 billion, and represented a major investment bank in a New York state court dispute concerning a stockholder agreement.
Mr. Rose later continued his commercial litigation and white collar practice at Dechert LLP. His representations included serving as lead counsel in New York state court litigation involving alleged contractual and New York City Department of Buildings violations between a commercial landlord and tenant; trial counsel to a Broadway theater company in a partnership and lease dispute that resulted in a favorable ruling before the Delaware Supreme Court; and trial counsel for a broker-dealer in a three-week FINRA arbitration concerning alleged synthetic futures trading losses exceeding $25 million.
He also represented clients in bankruptcy, employment, and real estate-related disputes, including serving as hearing counsel in opposition to LATAM Airlines’ Debtor-in-Possession financing proposal during expedited bankruptcy proceedings; representing Fox News in breach of employment contract litigation involving retaliation claims; and representing a residential developer in litigation involving municipal discrimination claims, religious land use issues, Article 78 proceedings, and related civil RICO allegations.
In addition to his commercial litigation work, Mr. Rose has represented individuals and organizations in government investigations and white collar matters involving the SEC, DOJ, and congressional inquiries. His experience includes serving as lead investigative counsel to a major transit authority concerning whistleblower allegations, representing a client before the Senate Permanent Subcommittee on Investigations in connection with pharmaceutical pricing inquiries, defending a government contractor in a DOJ overbilling investigation, and representing a military contractor in a matter involving allegations related to the transfer of U.S. military equipment.
Most recently, Mr. Rose served as an Assistant District Attorney in the New York County District Attorney’s Office Financial Frauds Bureau, which includes the Housing and Tenant Protection Unit. In that role, he investigated and prosecuted a wide range of financial crimes, including alleged Ponzi schemes, embezzlement, real estate and housing fraud, immigration fraud, and attorney fraud. He managed cases from investigation through trial and worked closely with law enforcement agencies and regulatory authorities throughout Manhattan.
Mr. Rose has also presented to legal organizations, corporate groups, community organizations, students, and fellow attorneys on topics including SEC Wells Notices, developments in civil procedure, prosecutorial ethics and responsibilities, and trial strategy.
