  • 201649681 - CLARK, COURISSA (INDIVIDUALLY AND AS NEXT FRIEND O vs. JEFFERSON, BETHANIEL (Court 281)
Served as co-counsel for a four-year-old girl who suffered catastrophic, permanent brain damage during a routine pediatric dental procedure in Harris County, Texas. The child was separated from her parents, strapped into a papoose board restraint, and given large doses of anesthetic and sedative medication. When she began seizing, the dentist described the episode to her parents as "the shakes," continued treatment behind a locked door, and administered additional medication without consent. Despite a computerized vital signs monitor that sounded audible and visual alarms, the dentist and staff disregarded roughly five hours of profound oxygen deprivation while the child's blood pressure and pulse spiked and crashed, and the restraint device further compromised her breathing. Her parents, who were held in the waiting room for approximately eight hours and repeatedly told their daughter was fine, were denied their requests to call 911 and to take her home. She was finally transported by ambulance and diagnosed at the hospital with permanent and profound brain damage. She is now unable to see, speak, or drink on her own and requires around the clock medical care for the remainder of her life. The suit was brought as a health care liability claim under Chapter 74 of the Texas Civil Practice and Remedies Code, alleging that the dentist breached the standard of care and seeking damages for past and future pain and mental anguish, physical impairment, lost earning capacity, and lifetime medical expenses.

This action arises out of the bombing on June 25, 1996 of the Khobar Towers apartment complex in Dhahran, Saudi Arabia, which housed United States military personnel, including the 14 service-member plaintiffs in this case. Also among the 35 plaintiffs are family members of these 14 service-member plaintiffs.
