Biography

Andrew J. Simons began his legal career as a law clerk for Judge William W. Bivins of the New Mexico Court of Appeals from 1992 to 1993. He then joined Sutin, Thayer & Browne APC, where he continues to practice in Albuquerque, New Mexico. His work focuses on Litigation – Bankruptcy, with an emphasis on commercial litigation, creditors’ rights, consumer law, and real estate matters.

Mr. Simons has represented clients in a wide range of state and federal litigation, including:

(1) representing creditors in complex commercial real estate foreclosure actions and loan workouts involving debt amounts ranging from approximately $750,000 to more than $150 million, and properties ranging from less than one acre to approximately 55,000 acres, including the defense of lender-liability counterclaims; (2) defending lenders against consumer claims alleging fraud, product defects, and unfair or deceptive practices arising from real estate and vehicle transactions; (3) representing lenders in commercial collateral recovery matters, including actions involving vehicle and parts inventories of automobile dealers and the recovery of equipment and other personal property securing capital and operating loans, as well as defending lender-liability counterclaims in those actions; (4) representing professionals and businesses, including accountants, construction contractors, and real estate appraisers, in commercial tort and breach-of-contract disputes; (5) prosecuting and defending statewide consumer class actions; and (6) defending title companies in matters involving tort, breach-of-contract, and unfair-practices claims.

Through his litigation practice, Mr. Simons regularly assists financial institutions, businesses, and professionals in navigating disputes involving bankruptcy-related issues, creditors’ rights, and complex commercial matters throughout New Mexico.
