Case History

Cases
  • McNamee v. Eighth Jud. Dist. Ct., 135 Nev. 392 (Nev. 2019)
Suggestion of death filed by counsel did not trigger 90-day deadline for filing motion to substitute, and, thus, dismissal of action was not warranted based on plaintiffs' failure to timely substitute counsel for defendant as party defendant. Trial court's denial of motion to substitute was arbitrary or capricious exercise of its discretion, warranting mandamus relief.
