Biography

Alex Rothenberg’s practice focuses on oil, gas and energy litigation and complex commercial and construction litigation. He also has experience in the areas of admiralty, insurance defense and family law. Alex was heavily involved in the multi district litigation concerning Chinese drywall and helped obtain the dismissal of one of his clients pursuant to the Foreign Sovereign Immunities Act. In re Chinese Manufactured Drywall Prods. Liab. Litig., 168 F. Supp. 3d 918 (E.D. La. 2018).

Alex’s practice also involves significant appellate advocacy for both plaintiffs and defendants. He has recently helped secure impressive wins in State and federal appellate courts. Alex assisted in obtaining the affirmance of a trial court judgment awarding his client, a residential developer, nearly $5,000,000 in damages and ordering the local government to allow his client to procced with constructing its development. Lonesome Dev., LLC v. Town of Abita Springs, 2021-1463 (La. App. 1 Cir. 05/29/22); 343 So. 3d 831, writ denied, 2022-01158 (La. 1/01/22); 349 So. 3d 3. In another matter, Alex helped secure his client approximately $4 million in registry funds after nearly 30 years of prior litigation. Jump v. McFarland, No. 21-30729, 2022 WL 2437586 (5th Cir. July 5, 2022). In representing defendants, Alex obtained a complete victory for his client, the Sewerage & Water Board, where plaintiffs sought to seize more than $10.5 million in state assets. Ariyan, Inc. v. Sewerage & Water Board of New Orleans, 29 F.4th 226 (5th Cir. 2022), cert denied, 143 S.Ct. 353 (2022). Most recently, Alex obtained a full dismissal of a Fair Housing Act claim against his client upon a rare interlocutory appeal. La. Fair Hous. Action Ctr., Inc. v. Azalea Garden Props., L.L.C., 82 F.4th 345 (5th Cir. 2023).

Before joining the firm, Alex clerked for the Honorable Nannette Jolivette Brown of the Eastern District of Louisiana. Alex was awarded the Dean’s Scholarship and served as Senior Articles Editor of the Tulane Law Review.

In his free time, Alex enjoys myriad hobbies such as running, tennis, squash, reading historical biographies, collecting vintage Jazz Fest posters, and spending time with his wife, Diana, and son, Declan.
