Biography
With over 30 years in the legal field, my journey as a lawyer has been marked by a commitment to fostering resolution and understanding through Collaborative Law and Mediation. Unlike traditional legal paths, something about mediation and helping people in conflict find a better, more productive way to resolve their differences attracted me to Mediation and Collaborative law.
While starting my career at a notable Fifth Avenue matrimonial litigation firm, I volunteered as a court mediator, witnessing firsthand the limitations of litigation in family disputes. These experiences reinforced my belief in the effectiveness of mediation and collaborative efforts over courtroom battles, prompting me to focus on building skills that aid family cohesion.
I am proud to be among those who embraced mediation and collaborative law as primary professions. Our firm, Berner Law & Mediation Group, established nearly three decades ago, aims to provide environments where individuals can resolve differences through cooperative problem-solving rather than adversarial processes.
Throughout my career, I have dedicated myself to fostering successful resolution practices while continuously enhancing my knowledge and abilities. I have studied with renowned mediation trainers across the United States, enriching my understanding with diverse methodologies. My education, including degrees in law and accounting and post-graduate studies at NYU School of Social Work, equips my practice with both the analytical skills necessary for complex legal and financial matters and insights into the emotional dynamics that often underlie disputes.
My firm’s mission is to assist clients in navigating conflicts to discover optimal solutions and maintain healthy relationships. My ongoing dedication to mediation and conflict resolution has led to roles as an educator and trainer. For over 20 years, I have served as an Adjunct Professor at Cardozo School of Law, and I also offer training sessions to attorneys, judges, and other professionals, frequently presenting at bar association events throughout New York and New Jersey.
As a leader in this evolving field, I have served as Past President of the Family & Divorce Mediation Council of Greater New York, and I held founding positions with the Collaborative Divorce Association of North Jersey, the New York Association of Collaborative Professionals, and the New Jersey Council of Collaborative Practice Groups. Additionally, I served as the Director of Training at the New York Center for Interpersonal Developments’ Mediation & Conflict Resolution Training Institute and instruct various panels and workshops, including the NJ Institute for Continuing Legal Education’s 40-hour divorce mediation training.
Beyond my professional endeavors, my wife and our four children remind me constantly that conflict resolution skills are always evolving and need nurturing both professionally and personally.

Q&A
Berner Law & Mediation Group was founded with the unique focus of helping individuals and families in conflict reach resolutions together, in a problem-solving way, instead of against each other, in a destructive way. Our law firm can offer you several advantages over traditional ways of divorcing, among them cost-effectiveness, durability, and a process that promotes respect rather than prolonging hostility.
Whether in the context of divorce (our primary focus), other family, family business, or workplace disputes, our client-centered approach seeks to create a safe and trusting space to engage in constructive dialogue and perspective-taking. We also conduct financial and legal analyses, where applicable, to provide a deeper understanding of the financial and legal realities. This helps clients make informed, optimal decisions about how to move forward in their lives.
Our Philosophy
Adam Berner, the founder of our firm, was one of the first lawyers in the New York and New Jersey area to practice Alternative Dispute Resolution. He saw families torn apart by divorce and other conflicts as they navigated the court system. He knew there had to be a better way.
Adam built a practice that places clients first, recognizing that divorce has many dimensions: legal, emotional, psychological, and parental. He built a team that maintained the same values. Our team is made up of people who believe the work we do is crucial because a courtroom is not the place to resolve family issues. Our practice creates a trusting environment that facilitates conversation between divorcing spouses and other disputing parties, encouraging them to understand the facts of the situation, address each other’s priorities, and take charge of shaping their futures through mediation and collaborative law.
What is divorce mediation?
Divorce mediation is a confidential, voluntary process where a neutral mediator helps both parties reach agreements. The mediator facilitates discussion but does not take sides or make decisions. The goal is to reach a mutually acceptable settlement outside of court.
How does mediation work?
The mediator facilitates discussions and helps explore options. The mediator does not make decisions; all outcomes are decided by the parties.
What issues can mediation address?
Mediation can address custody, parenting time, child support, alimony, division of assets and debts, and other divorce-related concerns.
Is mediation right for my situation?
Mediation works best when both parties are willing to participate in good faith. It can be effective even if communication is difficult. We can schedule a consultation to help determine if mediation is appropriate.
Do both spouses need to agree to mediation for it to work?
Yes, mediation is voluntary and requires participation from both parties. If one person is unsure, we can explain the process to help them understand the benefits.
How long does mediation take?
Some matters are resolved in a few sessions, while others take longer, depending on complexity and cooperation.
What is the cost of mediation, and how is it billed?
Mediation is billed at an hourly rate. Costs depend on the number of sessions and the complexity of the issues. We can explain current rates and payment policies during intake.
Is mediation confidential?
Yes. Mediation communications are confidential.
Do I need an attorney during mediation?
While not required, many clients choose to consult with an attorney for guidance. It is recommended to have an attorney review the final agreement before signing.
What happens after we reach an agreement?
The mediator prepares a settlement agreement that can be reviewed by attorneys. Once the agreement is signed, an uncontested divorce can be filed.
