Aaron Kreaden is a partner practising in the Litigation & Dispute Resolution Group. He has a broad civil litigation practice, which includes corporate-commercial litigation, complex negligence (professional and otherwise), directors’ and officers’ liability, class actions, and product liability. He has appeared at the Supreme Court of Canada, as well as various levels of court in Ontario, British Columbia, Alberta and Nova Scotia.
Aaron has acted on some of Canada’s most significant auditors’ negligence mandates. He was counsel for Livent (through its special receiver) at trial, the Ontario Court of Appeal and the Supreme Court of Canada. He also acted for one of the largest investors in Bernard Madoff’s fund in connection with its Canadian case against its auditors. Aaron also regularly acts in the defence of claims against auditors and other professional advisors. He acted for WBLI in its successful summary judgment motion to defeat an auditors’ negligence claim, which also went to the Supreme Court of Canada on the issue of expert independence.
Aaron also regularly acts in complex shareholder disputes and claims against directors and officers. He is frequently retained by insurers to represent their insured directors and officers and other entities, including in class actions. He has most recently been involved in several mandates relating to oppression and forced buyouts in the context of large, family-run businesses both on Ontario’s Commercial List and in Arbitration.
In addition, Aaron is also frequently called upon by clients to assist in a range of special situations, including fast paced injunctions, internal investigations, proxy fights and other shareholder activist matters.
