Public Law Definition
Procurement law is also known as public procurement. It encompasses all laws and regulations that the public sector (such as cities, municipalities, and public service providers such as hospitals) is bound to in awarding construction, supply, and service contracts. Moreover, procurement law includes protective measures for bidders against violation of said laws and regulations, for example, in the form of review procedures. Public procurement law in Germany is marked by European directives aimed at standardizing procurement laws throughout the European member states. Thus, the latest reform of German procurement law is slated for 2016 in line with Directive 2014/24/EU.
As a result, any contracts not awarded at market prices will be subject to specific pricing regulations.
All this makes procurement law an extremely complex law field, whose significance for the public sector has been steadily rising for many years when it comes to the procurement of goods and services. Consulting services for the public sector and bidders alike include the following:
- Organization and implementation of tendering procedures for awarding construction, supply and service contracts
- Procurements in the utilities sector and the defense and security sector
- Advice on pricing regulations
- Concessions awards
- Contract drafting and negotiations specifically for PPP contracts
- Legal and strategic bid management
- Compliance consulting
- Review procedures and litigation for damages
Aside from procurement law expertise, attorneys practicing in this field of law should be able to offer additional qualifications in order to provide competent advisory services in a law field known for complex litigation and proceedings. Particularly, extensive know-how in contract law is a must. Ideally, attorneys in this law field should also have in-depth knowledge in pricing and compliance regulations as well as tort law. Any cases involving contracts not awarded at market prices make experience in dealing with pricing regulations indispensable.
