Understanding Dram Shop Laws

Most people understand that a drunk driver can be held responsible when they cause an accident. What is less commonly known is that, in certain situations, a bar, restaurant, or other business that served the alcohol may also face legal responsibility. These situations are addressed through what are known as Dram Shop laws.

What Are Dram Shop Laws?

Dram Shop laws are state statutes that allow people injured by an intoxicated individual to pursue a legal claim against the business that served the alcohol. The purpose of these laws is to encourage responsible alcohol service and to provide a potential source of recovery when over-service contributes to injuries or property damage.

When Do Dram Shop Laws Apply?

The specific requirements vary from state to state, but Dram Shop liability may arise when a business:

  • Serves alcohol to someone who is visibly intoxicated
  • Serves alcohol to a minor
  • Continues serving alcohol to a person who presents an obvious risk to themselves or others

Claims under Dram Shop laws are not limited to motor vehicle accidents. They may also apply in situations involving assaults, bar fights, falls, or property damage caused by an intoxicated person.

Why These Laws Matter

Dram Shop cases can be legally and factually demanding. They often require evidence such as witness statements, surveillance footage, transaction records, and testimony regarding alcohol service practices. Time is also an important factor, as many states impose shorter notice requirements or filing deadlines than those found in other personal injury cases.

State laws differ on who may bring a claim and what damages may be recovered. In some jurisdictions, the person who was over-served may have limited rights to pursue compensation, while in others they are excluded altogether. Some states also impose caps on damages, while others do not.

Dram Shop claims may provide an additional avenue for recovery, particularly in situations where an intoxicated driver lacks sufficient insurance coverage.
