The Growing Risk of Uninsured and Underinsured Drivers

Uninsured and underinsured motorists present a serious social and economic challenge for drivers across the United States. Financial pressures over the past several years have contributed to an increase in the number of people driving without adequate auto insurance. National studies estimate that approximately 16 percent of drivers have no automobile insurance at all, while many others carry only the minimum liability coverage required by their state.

In Pennsylvania, and particularly in the Philadelphia region, the percentage of uninsured and underinsured motorists is significantly higher than the national average. This reality creates substantial risk for anyone traveling on the roadways. When accidents occur, injured individuals may find that the at-fault driver lacks sufficient coverage to pay for medical bills, lost wages, and other damages.

Challenges in Recovering Compensation

Accidents involving uninsured or underinsured motorists often lead to complex insurance issues. In many cases, injured parties must turn to their own auto insurance policies for compensation. Even then, policyholders may encounter delays, denials, or other obstacles during the claims process. Disputes with insurers can sometimes raise concerns about unfair claim handling or bad faith practices.

Understanding policy language, coverage limits, and applicable state laws is critical in these situations. Without careful attention, injured individuals may unknowingly accept less compensation than their policy allows.

Holding Insurers and Responsible Parties Accountable

For many people injured by uninsured or underinsured motorists, uninsured/underinsured motorist (UM/UIM) coverage is a primary source of financial recovery. Carrying “full tort” coverage and meaningful UM/UIM limits can play an important role in protecting oneself and one’s family.

It is also important to be aware of several common issues that arise in these cases:

  • Policyholders with UM/UIM coverage may still face claim denials, prolonged delays, or discouragement from filing a claim.
  • In some cases, a thorough investigation into the at-fault driver or other potentially responsible parties may reveal assets or sources of recovery beyond stated insurance policy limits.
  • Defendants may attempt to conceal or shift assets, making detailed investigation and financial review an important part of the process.

Given the prevalence of uninsured and underinsured motorists, understanding your insurance coverage and your legal options before an accident occurs can make a meaningful difference if the unexpected happens.
