Brophy & Devaney has established long-standing relationships with many of the individuals and businesses the firm has represented over the years, thanks to the countless favorable results it has achieved for its clients. As co-founder and owner Joseph F. Brophy observes, trust is essential to the success of these relationships.

"Trust is earned by always being prepared and listening closely to your client while also being candid and honest and forging realistic expectations based upon the applicable facts, circumstances, law and the parties’ respective points of leverage,” he says.

Over the past two decades, Brophy & Devaney has gained the trust and confidence of clients across the country and internationally through its work in various areas, including business divorces, breach of contract actions, commercial property and development disputes, insurance actions, professional malpractice claims, intellectual property disputes, and IP and cyber-litigation.

“People and businesses have come to central Texas in droves over the last 20 years, and in that time, I’ve sharpened and refined my skills and gained tremendous experience and wisdom,” notes Brophy, who has represented many U.S. and international clients entering the Austin market for the first time.

“Clients new to the area are often skeptical about being taken advantage of or have concerns about local venue rules and Texas law. We provide skilled expertise and absolute loyalty and all that entails for our clients. Indeed, without loyalty, there is no trust, which so often is critical in deciding whether to say, ‘yes’ or ‘no’ to a litigation strategy or a business deal.”

In addition to litigation services, the firm provides general counsel services to individuals, family offices and businesses on a wide range of business and financial issues. The firm often serves as outside general counsel and acts as the lead deal lawyer, be it on any type of contract to the merger or sale of a business. “We wear at least two hats for our clients—confidentially as their confidant and counselor and more publicly as their advocates,” says Brophy.

While most business litigators have limited trial experience, Brophy began his career as an insurance defense lawyer trying cases before a jury, which appealed to his competitive nature. The skills Brophy developed as a young trial lawyer have been seasoned and sharpened as he has continued to handle larger and more complex cases over the last 25 years. At the same time, he has served as outside general counsel for several companies and advised numerous business clients on all manner of deals and operations.

“We continue to handle lawsuits nationally, with cases currently stretching from Alabama to Massachusetts to Oregon, while maintaining our primary emphasis in Texas,” says Brophy. “We have business clients from across the globe, and while it’s challenging, it’s also very satisfying and keeps you young and challenged. There is no place for complacency or resting on one’s laurels.
