West as Secretary of US Army; US Army Corps of Engineers, et. al. — Sussessfully defended a citizen group''s attempt at overturning issuance of a wetland permit to a developer. The case was dismissed by the Second Circuit on the basis of laches. It is very seldom that laches has been the basis of dismissing an environmental case.
Sale of Morton International Inc. to K+S AG — Represented the buyer (K=S AG) of Morton Internatinal Inc.(Morton Salt) for $1.6 billion (US). My team performed environmental due diligence and successfully negotiotiated a structure to protect buyer from potentially significant environmental liabilities within a very short time frame.

US — This case decided by the Supreme Court of the US strengthened State''s rights under the 10th amendment by overturning a law that made states responsible for low level radioactive waste generated in the state if the state. A state''s responsibllity was not conditioned on any actionsby the state and there was nothing the state could do to avoid this responsibility.
