Case History

FDIC v. Hurwitz — Represented FDIC on appeal from federal district court decision against it awarding sanctions in excess of $70 million for violation of FRCP 11 in filing suit against defendant.  U. S. Fifth Circuit reversed and remanded.
American Petroleum Institute v. Environmental Protection Agency — Represented oil and gas industry in challenging validity of regulations issued by EPA under the Clean Water Act regulating discharges of industry waste water.  Case involved complex issues of enormous importance industry-wide.
Henry v. Ballard & Cordell — Case of first impression decided by Louisiana Supreme Court interpreting meaning of "market value" gas royalty clause in Louisiana mineral leases as applied to production of natural gas.
