David Blount is a partner in the Portland office of Landye Bennett Blumstein LLP. He has directed the firm's multi-state environmental practice group since 1989. Mr. Blount has thirty years of regulatory and litigation experience in environmental law, insurance and hazardous substance issues. A former enforcement attorney at the U.S. Environmental Protection Agency Headquarters, Mr. Blount represents industrial, manufacturing, transportation, financial services, real estate businesses and educational facilities with permit needs, claims and transactions involving environmental and regulatory issues. He has in-depth experience with federal, state and local regulatory programs and tries cases in state and federal courts and administrative agencies.
University of Portland Purchase of Triangle Park LLC Property — In 2008, the University of Portland closed on its purchase of approximately 35 acres of contaminated upland industrial property from Triangle Park LLC. The property is a State of Oregon State Superfund Site that abuts the federal Superfund Site known as McCormack and Baxter and is within the current bounds of the federal Portland Harbor Superfund Site. The transaction was facilitated by the first Bona Fide Prospective Purchaser Agreement with EPA in the nation under EPA''s Nov 2006 BFPP Policy. The Agreement caps the University''s exposure for removal action costs at $4.2 million dollars. In addition, UP entered into a PPA with the State of Oregon DEQ that was filed as a Consent Judgment with the Multnomah County State Court. This dual federal/state PPA arrangement is the first and only such environmental due diligence/Brownfield mechanism undertaken in Oregon.
