Over the past decade, town planning and zoning regulation in Russia has been undergoing intense development. In general, strategic planning/zoning in Russia is regulated by the Land Code and the Town Planning Code of the Russian Federation. These codes set out the general legal rules which control the development and use of land and the construction procedure. In addition, there are also documents which are developed at the federal, regional, and local levels and establish planning and zoning restrictions for each particular area/site. Considering the huge area of the Russian Federation and the variety of landscapes (flat, mountainous, coastal, etc.), there are many regional and local acts which prescribe development rules.
The task of the lawyer is to provide the investor’s technical and commercial team with clear information on the legal status of the project site, on development restrictions, and on the regime of applicable encumbrances and limitations which may substantially affect the efficiency and commercial viability of the entire project. Land use and zoning lawyers also help investors in overcoming administrative and bureaucratic difficulties, for example preparing the set of documents required to obtain the necessary approvals and authorizations, including construction and commissioning permits which are the principal documents in the construction process.
