Tom Yoder focuses his practice on commercial insolvency matters, specializing in business bankruptcies and commercial workouts. Having more than 38 years of experience, he has represented every bankruptcy constituency, including secured creditors, trade creditors, Creditor's Committees, Trustees, lessees/lessors, bond holders, equity interests, selected debtors, asset purchasers, and venture capital entities. He has participated and appeared in bankruptcy cases throughout the Eastern United States, specifically the Southern Districts of New York and Delaware, and has experience in all aspects of the bankruptcy process, including estate administration, bankruptcy financing, asset sales, litigation (particularly defending preference and fraudulent conveyance adversary proceedings), discharge issues, confirmation, post-confirmation matters, and bankruptcy appeals.
Tom also practices in the areas of commercial litigation, commercial alternative dispute resolution, and state court receiverships.
Tom has been recognized for professional achievement on numerous occasions. He is a Fellow of the American College of Bankruptcy and is a former member of the board of directors of the American Bankruptcy Institute. He is a past president of the Indiana State Bar Association and has held numerous leadership positions within the Indiana State Bar Association, Indiana Continuing Legal Education Forum (President), the Indiana Bar Foundation (Fellow/Board of Directors), the Allen County Bar Association (Board of Directors), and the Seventh Circuit Bar Association. He has been awarded Sagamore of the Wabash distinction, Indiana's highest citizen honor.
An avid cyclist and runner, Tom has completed 18 marathons, including six Boston Marathons. He also has been an indoor cycling YMCA instructor for almost 20 years.
Tom is a frequent speaker at local, state, regional, and national legal education seminars, having given more than 150 presentations to lawyers and business personnel, including more than 100 for the Indiana Continuing Legal Education Forum. He has published two books on commercial bankruptcy as a co-author, winning the American Bankruptcy Institute's Publication of the Year award for 1997.
Tom has received numerous professional honors, including being an AV® Preeminent™ rated attorney by Martindale-Hubbell, based on peer review ratings. He has also been selected for the past 20 editions of the Best Lawyers in America®, every Indiana edition of the Indiana Super Lawyers®, Fort Wayne Best Lawyers including "Bankruptcy and Creditors' Rights Lawyer of the Year," and Super Lawyers in America®.
Tom earned his B.A., cum laude, in 1974 from Hanover College and his J.D. in 1977 from Indiana University Maurer School of Law. He is admitted to practice in Indiana state courts, the U.S. Court of Appeals for the Seventh Circuit, the U.S. District Courts for the Northern and Southern Districts of Indiana, and the Bankruptcy Court for the Eastern District of Michigan.
