Thomas Markle focuses his practice on ERISA and IRC compliance; health, disability, cafeteria, and educational assistance plans; COBRA; and HIPPA portability and nondiscrimination rules. He also focuses on ERISA litigation, including benefit claim litigation, fiduciary litigation, benefit discrimination litigation, and subrogation litigation. His representative clients include Parkview Health Systems, Fort Wayne Community Schools, Steel Dynamics Inc., City of Fort Wayne, OmniSource, third-party administrators, general underwriters, reinsurers, and preferred provider organizations.
Thomas has testified as an experience witness on various ERISA issues — QDROs, QMSCOs, ERISA jurisdiction, and health plan issues — in state and federal courts and has worked with representatives with the IRS, DOL, and CMS involving compliance with HIPAA non-discrimination rules and advising clients on wellness rules. He has drafted and implemented multiple complex "crossover" welfare plans which involved HRAs, HSAs, 125 plans, wellness plans, and group health plans for his clients.
A frequent author and speaker on various employee benefit issues, Thomas uses his speaking engagements to educate others on health and welfare plan issues. He has been selected for inclusion in the Best Lawyers in America® publication in the field of employee benefits since 2007 and is a member of the Allen County, and American Bar associations. He is also past president of the Parkview YMCA, the Fort Wayne Education Foundation, and Fort Wayne Habitat for Humanity.
Thomas is a graduate of Indiana University, where he earned his B.S. with high distinction in 1982 as well as his J.D./M.S.B.A, cum laude, in 1986. He is admitted to practice before the Indiana state courts, the U.S. District Courts for the Northern and Southern District of Indiana, the U.S. Court of Appeals for the Sixth and Seventh Circuits, and multiple federal district courts throughout the United States.
