Stephen Moore as Mediator
Insurers, plaintiffs, and counsel alike find Stephen’s thorough preparation, respectful attitude, and refusal to give up during the mediation process to be an effective combination for settling cases. Stephen brings almost forty years of tort experience to his vocation as mediator, and is well known for handling an impressive variety of cases, including: motor vehicle, occupiers’ liability, product liability, governmental liability, and professional liability (including doctors, lawyers, engineers, real estate agents, and insurance brokers).
Stephen’s experience is augmented by his acknowledged expertise in the area of motor vehicle law, particularly with respect to the operation of Ontario’s tort reform automobile compensation system and the vicarious liability rules enacted in 2006 with respect to leased and rented vehicles. Stephen lectures often on causation and mitigation of damages, and has authored many papers on calculating damages in motor vehicle cases - all of which are repeatedly referred to by lawyers practising in this area.
Stephen Moore as Lawyer
Although Stephen’s mediation practice is growing, he maintains an active regulatory and defence practice. Focusing mainly on significant and complex motor vehicle defence cases, automobile coverage opinions, and automobile insurance regulatory issues, Stephen’s client-centric approach to his practice allows for proper evaluation of cases from the outset. With a view to settling early, Stephen helps his clients understand the ultimate potential value of large loss files and is ever vigilant for opportunities to achieve advantageous settlements. If a reasonable settlement cannot be achieved, he has a record of successfully trying such cases.
Insurers that find themselves in need of assistance in dealing with the Financial Services Commission of Ontario have a very limited number of lawyers they can turn to. Stephen is one of those lawyers. He has been successfully assisting major insurers in their dealings with FSCO since the early 1990s. Among the myriad of issues that he has consulted on include: automobile rate filing concerns, withdrawal from the automobile insurance market, getting approval for a rating product, and compliance with the automobile form approval process. These issues have the potential to lead to major difficulties for insurers, including putting their licences at risk. Stephen’s adept handling of these issues can help minimize such risks.
