Lani Carter is an experienced commercial and insurance litigator, specialising in professional indemnity and appearing in all jurisdictions from the Magistrates Court to the Supreme and Federal Courts.
What she does
Lani helps professionals to continue to practice in their chosen fields by defending claims made against them and complaints made to professional bodies. She also acts in Royal Commissions and inquiries. Lani enjoys disentangling complex claims, often with the assistance of experts and prides herself on quickly understanding the commercial risks faced by insurers and their insureds. She regularly advises insurers with respect to proportionate liability, suspected fraudulent claims and double insurance. Lani also assists insurers to recoup losses by pursuing recovery claims.Some interesting examples of claims she has worked on recently were - a multimillion dollar train derailment; acting for a number of insureds in the Aged Care Royal Commission; a claim against a psychologist involving alleged misdiagnosis; and a claim involving the spontaneous combustion of hay bales. Lani is particularly proud of her work in a recent pro bono set of proceedings commenced in the Supreme Court under the Law of Property Act 1936 (SA), which resulted in recouping funds stolen by a family member of her client in an ‘elder abuse’ claim.Lani gives back to the industry by donating her time and expertise as a Committee member of the Australian Insurance Law Association, assisting with the preparation and provision of insurance law seminars for brokers, claims workers and lawyers.
