Ken Barton concentrates his practice in the areas of commercial transactions, commercial litigation, real estate, and estate planning. He has tried numerous cases in state and federal courts in Virginia, West Virginia, and the District of Columbia and has also argued cases before the West Virginia Supreme Court of Appeals, the Virginia Supreme Court, the District of Columbia Court of Appeals, and the United States Court of Appeals for the Fourth Circuit. Mr. Barton is the Managing Member of the Martinsburg office.
REPRESENTATIVE EXPERIENCE
- Represented the developer of a 1,200-home residential subdivision, including acquisition of the property, advising the client regarding land use issues, and appearance before the planning commission
- Represented lenders regularly in multi-million dollar financing transactions, including preparation of all loan documents and advising the lender as to real estate title issues
- Served as counsel to the developer of a major shopping center which included all land use issues and appearances before the planning commission; handled all financing transactions as well as the sale of several outparcels; prepared leases for stores that the developer retained and is leasing to other entities
- Represented a hotel developer in multiple refinancings with each in excess of $7 million
- Served as counsel to a developer regarding an increased tax assessment appeal
- Represented developers of multiple residential subdivisions in Berkeley, Jefferson, and Morgan counties
- Represented developers seeking to subject property to conservation easements
- Represented the purchaser in the purchase and development of a summer camp for underprivileged children from Baltimore
- Represented a real estate developer with planning and zoning ordinances for shopping centers
