Clients: In addition to working with traditional developers and commercial property owners, much of John’s practice focuses on working with clients in communications businesses, including wireless, cable, and fiber optic. These clients include national communications service providers and owners and users of communication-oriented structures. John assists these clients with the acquisition and disposition of their real estate assets and deployment of their communication networks by addressing transactions, including title due diligence and land use.
Transactions: John has served as the primary outside counsel for communications clients in various national and regional real estate transactions, including: (a) purchase and sale agreements and associated documentation; (b) leases, licenses and easements pertaining to developed and undeveloped land; (c) in-building systems; (d) distributed antenna systems; and (e) office, call center, switching center, retail and warehouse purchase and leasing. John has been the lead attorney on the original build outs of the infrastructure deployment for communication networks of several of the leading national communications companies including for example: (i) network deployment projects for different clients in all western states; (ii) the network build out for another client in all of its original national markets in various parts of the country; (iii) several metropolitan specific network projects; and (iv) the fiber optic network of a national communication company throughout the Puget Sound region and greater Portland area affecting approximately 25 municipalities.
Land Use: John also regularly assists clients with land use projects, including: (a) zoning, subdivision, and general land use due diligence; (b) land use permits and variances including representing clients before governmental entities at contested and other public hearings; (c) administrative and state and Federal court appeals of land use permit denials and the defense of such appeals that are adverse to our client's interests; (d) rights-of-way access permits and agreements and (e) cable and fiber optic project municipal franchises and rights-of-way permits. John's land use experience originated with his prior positions as a municipal land use hearings examiner for the cities of Seattle and Bellevue and has extended into private practice for many years throughout Washington state as well as other states.
