Jamie Leary counsels corporate clients on a wide variety of ERISA and employee benefits issues, drafts plan documents and employee communications for pension and welfare plans, advises on day-to-day benefits issues; and prepares governmental filings for qualified and non-qualified plans. She also has experience in reviewing executive compensation issues and advising on fiduciary regulation matters.
- Drafts employee benefit plans to correspond with employers’ desires to offer retirement, health insurance, tuition reimbursement and other benefits.
- Counsels employers concerning the interplay of ERISA, the Internal Revenue Code, and other federal laws such as FMLA, HIPAA, COBRA, ADA and West Virginia WPCA. Assists plan sponsors in making sense of the rules and regulations that govern.
- Assists plan sponsors in identifying and correcting errors in qualified retirement plans in accordance with U.S. Department of Labor and Internal Revenue Service requirements. Because she works with plan sponsors on a timely basis and before errors are found on audits, corrections are much less expensive and, in some instances, can be completed without a government filing.
