David R. "Chip" Barry, Jr.,  a Chicago personal injury and medical malpractice attorney, joined the firm of Corboy & Demetrio as a partner in April 2002. He practices in the area of medical negligence, where he has focused his efforts since graduating from Northwestern University School of Law in Chicago, Illinois, in 1981. Prior to 2002, he represented defendants in personal injury cases. Whether representing plaintiffs or defendants, Barry has earned the respect of the judiciary and the trial bar for his ability, professionalism, good nature, and success.  During the past six years, Chip has obtained more than $156 million on behalf of his clients.  In one of his recent record-setting cases, a jury awarded $22 million - the largest verdict ever for a Chicago personal injury lawyer in a medical malpractice case in Illinois for the death of a woman - to the family of a 34 year-old mother who died after childbirth. The doctor and nurse failed to properly treat her acute high blood pressure. In another case of medical malpractice, Chip obtained a settlement of $19.5 million for a 41 year-old man who was not immediately treated for a stroke at an Illinois hospital. When a hospital staff failed to deliver an infant in a timely manner despite indications he was not tolerating labor, Chip obtained an $11.5 million settlement on behalf of the parents of the boy born brain damaged and with cerebral palsy. And when a 6-year-old boy was blinded in one eye after being treated at a Chicago hospital for a recurring bloody nose, Chip secured a $3.8 million settlement on behalf of the boy.  Chip was recently inducted into the prestigious, invitation-only, American College of Trial Lawyers and is a Past President of  The Society of Trial Lawyers. He has served as President of the Trial Lawyers Club of Chicago and is a member of the Chicago Bar Association, Illinois State Bar Association, American Bar Association, Illinois Trial Lawyers Association and the American Association for Justice.  Selected by his peers for membership in the Leading Lawyers Network, an organization of the top 5% of lawyers in Illinois, Chip also has an AV rating - the highest level awarded for professional excellence - by the Martindale-Hubbell Law Directory.  He has also been designated an Illinois Super Lawyer.  Chip frequently lectures for the Illinois Institute of Continuing Legal Education on discovery tactics and trial practice and has taught medical-legal seminars across the country.

$11.5 Million Settlement for Failure to Deliver Infant in Timely Manner

Corboy & Demetrio attorney David R. Barry, Jr., secured a $11.4 million settlement on behalf of parents who sued after their son was born with brain damage and cerebral palsy.  Northwestern Memorial Hospital and the doctor involved with the birth were defendants in the medical negligence lawsuit.  During delivery, fetal monitor tracings indicated the baby was not tolerating labor and instead of working quickly to deliver the infant, the doctor allowed the mother to continue to push, thinking that with one or two more pushes, the baby would be delivered. Unfortunately, the baby was not delivered until the fifteenth push, some thirty-one minutes later.

$19.5 Million Settlement for Failure to Properly Treat Stroke Victim

A former Global Controller for Chicago-based Citadel Hedge Funds, represented by Corboy & Demetrio partner David Barry, Jr., agreed to a settlement with Evanston Northwestern Healthcare Corporation of $19,500,000. Evanston Hospital failed to treat the Controller with the clot busting drug, tPA, after he went to its Emergency Department with symptoms suggestive of stroke. After being admitted, the nurses failed to respond to the wife of the Controller who repeatedly requested that her husband be re-evaluated. The stroke went undiagnosed and evolved over 12 hours, resulting in significant expressive and receptive aphasia.

$7.25 Million Settlement in Product Liability Case Where Victim Suffers Burns Over 90% of His Body

Timothy Gould, 35, suffered third-degree burns over 90 percent of his body when a 55-gallon drum, which had previously contained Satin Cement Seal and was manufactured by NCH Corporation, exploded as he approached it with an acetylene torch. Gould had emptied the barrel three days before and believed it to be dry. He was hospitalized for eight months and underwent seventeen skin grafting procedures. Partners David Barry, Jr. and Robert Bingle represented Gould and his wife in the $7.25 million settlement of their case against the Texas chemical company. 

$6.75 Million Settlement with The University of Illinois at Chicago Hospitals

When he was little, the younger brother of a kidney dialysis patient told his older brother that he would one day donate his kidney to him. When the young man turned 18 years-old, he underwent surgery at the University of Illinois Hospital to fulfill his promise. Soon after surgery though, the young man experienced pain, swelling, and vomiting and died shortly thereafter. The family, represented by David R. Barry, Jr., agreed to a settlement of $6.75 million with the Hospital for the death of the 18 year-old who died of an overwhelming abdominal infection 13 days after donating his kidney to his older brother.

$22 Million Record-Setting Jury Verdict for Family in Death of Mother After Childbirth

A Cook County jury awarded a record $22 million to the family of Rachelle Bentivenga, a 34 year-old mother, who died after giving birth because the labor and delivery room doctor and nurse at St. Francis Hospital in Evanston, Illinois, failed to properly treat her acute high blood pressure. It is the largest Illinois medical malpractice verdict for the death of a woman. Attorneys David Barry, Jr., and Susan Schwartz represented the family.
