Partners Fred A. Tecce and Dennis J. Butler have successfully defended a motion to disqualify the firm from representing a patent owner in a patent infringement case in the U.S. District Court for the District of Delaware.
Judge Christopher J. Burke ruled that Panitch Schwarze’s prior representation of the defendant in the case, Munchkin Inc., in trademark matters does not disqualify the firm from representing the plaintiff, Regalo International LLC, in the patent dispute. The case concerns alleged infringement of three patents for children’s bed rails.
Tecce and Butler both are veteran patent litigation attorneys. Tecce has successfully handled cases on behalf of intellectual property owners, and in defense of charges of infringement and misappropriation in industries such as consumer products and appliances, medical devices, juvenile products, building materials, cosmetics, aircraft manufacturing, telecommunications, artificial turf and other technologies.
