Thomas D. Rein is a global co-chair of Sidley’s intellectual property practice and is the head of Sidley’s Chicago IP group.  The focus of Mr. Rein’s practice is on intellectual property disputes, most particularly patent infringement suits.  Mr. Rein is widely recognized in this area, including by Best Lawyers in America, Who's Who Legal, IAM Patent 1000, IP Stars and LMG Life Sciences.  Mr. Rein is a highly successful trial lawyer and a Fellow of the American College of Trial Lawyers.  He has had sweeping successes before juries on behalf of both plaintiffs and defendants in several recent high stakes patent cases.   For example, in June 2012, Mr. Rein represented National Pasteurized Eggs at trial against its only U.S. competitor, Michael Foods.  The jury invalidated the three patents asserted by Michael Foods and found that all three of National’s patents were valid and infringed, awarding lost profits and price erosion damages.  In December 2010, Mr. Rein represented plaintiff SynQor at trial against eleven competitors.  The jury found for  SynQor on each of the five asserted patents and awarded $95 million in lost profits and price erosion damages.  Earlier in that same year, Mr. Rein successfully represented defendants Aircell (now Gogo) and Delta Airlines; the jury found no infringement and that the patent claims were invalid on each of the four grounds urged by defendants.  Prior to that, Mr. Rein represented Ethicon Endo-Surgery (EES) in a dispute over the ownership of patent applications.  The jury found for EES on each of the grounds urged and awarded damages; the Court then upheld the damage award and re-assigned the patent applications to EES.  Mr. Rein is a 1980 summa cum laude graduate of Colgate University and a 1983 cum laude graduate of Harvard Law School.

Case History

SynQor v. Artesyn, et. al. (E.D. Tx)

Lead trial counsel for SynQor against eleven of its competitors in a case tried in December 2010.  The jury found that all five asserted patents were infringed, were not invalid, and awarded more than $95 million in damages.  The Court went on to reject all of the Defendants' many challenges to the jury verdict, entered a permanent injunction and awarded supplemental damages and sanctions, adding nearly $20 million more to the final judgment.  The verdict was one of the largest verdicts of 2010 and has since been affirmed on appeal.

National Pasteurized Eggs v. Michael Foods (W.D. Wisc.)

Lead trial counsel for National Pasteurized Eggs ("National") in patent infringement suit involving three of National's patents directed at the pasteurization of eggs in their shells and three of Michael Foods' patents directed at the same.   The jury ruled for National across the board, invalidating each of Michael Foods' patents and finding infringement of each of National's patents.   The jury awarded lost profits and price erosion damages, and the Court entered a permanent injunction.   The case was tremendously important for National because its principle product line was at risk, and Michael Foods, a far larger company, was National's only competitor.
