Case History

Nobel Systems Corporation v. Tech Squad et. al., USDC Colorado, Civil Action No. 09-cv-02616-PAB-KLM — Represented Plaintiff software manufacturer in asserting claims for misappropriation of  trade secrets,violation of non compete agreements and related claims against former employees and their new employers. Obtained Temporary Restraining Order, Prelimnary Injunction and Permanent Injucunction against Defendants.
Meritain Health Inc. v. McFerrin et. al., USDC Colorado, Civil Action No. 07-cv-01772 REB. — Represented corporate Plaintiff in trade secret misappropriation case against former employee and his new employer.  Obtained Temporary Restraining Order, Preliminary Injunction and Permanent Injunction agasinst Defendants.
Henry v. U S West, USDC Colo. Civil Action No. 96-N-724 — Complaint asserted ERISA claims on behal of a class, ADEA and state common law claims . Obtained dismissal  of class claims pre trial.  After two week trial, jury returned defense verdict on all claims except nominal award on one common law claim.
Gormly et al v Blumenthal et al, USDC Colorado, Civil Action No. 03-F-1012 (CBS) — ERISA class action asserting breach of fiduciary duty and related claims against Trustees of ESOP.  Obtained dismissal of all claims.
Carnagua et al v FMC Corporation et al, USDC Southern District of Indiana, Case No. 1:04-CV-1566 -LJM-VSS — ERISA class action where Plaintiffs asserted right to life time retiree health care benefits.  Obtained Summary Judgement for defendant on all claims.
