Michael Hornreich focuses his practice in the areas of construction law and construction litigation, in which he has wide-ranging experience in trial, arbitration and administrative proceedings. Prior to commencing his legal career, Mike was an engineer with Hazen & Sawyer, Civil Engineering Consultants in Hollywood, Florida, where he participated in the design of major wastewater treatment and disposal facilities, as well as for several major pulp and paper mills. Mike's extensive experience trying major construction disputes to juries, as well as bench trials, board proceedings, and arbitrations, enables him to get right to the bottom line on new cases.

Significant Representations

  • Represented numerous clients on projects valued up to $1 billion and resolved claims up to $100 million.
  • For the second time in the same matter, Mike and his trial team compelled payment of $52.8 million. First, on behalf of the University of Central Florida Foundation, Mike compelled the bond insurer, MBIA, to fund $52.8 million to fully repair water and termite damage to a 37 building student housing complex. MBIA then retained Mike to pursue recovery of the repair costs from the property manager, publicly traded American Campus Communities. In the fourth week of a jury trial, the property manager agreed to MBIA’s settlement demand and reimbursed MBIA for all amounts spent for the repairs plus attorneys’ fees and interest.
  • Represented the only known instance of a bond insurer funding repairs of this nature, and to this extent. It is also noteworthy that the firm pushed the case to trial and, therefore, the settlement was achieved within eight months of completion of the repairs.
  • Acted as lead trial counsel for the Florida Department of Transportation for two cases that were tried to jury. In the first, Mike defeated the contractor's claim for more than $10 million. In the second, obtained a jury verdict in favor of FDOT, defeating the contractor's claims for lost profit due to impaired bonding capacity and a measured mile claim, totaling more than $60 million with interest exposure.
Part 2

  • Advised contractors on how to successfully prepare and present claims to owners on federal and state projects – from levee flood walls to interstate highways and bridges. Guidance on proof of complex technical issues and recoverable damages.
  • Counsels civil design firms on the validity of contractor claims and proper claims handling.
  • Simultaneously commenced, pursued and secured recoveries of multimillion-dollar amounts for two different contractors on unrelated matters. Both settlements were within three months of filing suit as a result of the strategies devised and aggressively pursued by the firm.
  • Developed techniques for proving cases at trial that enable the presentation of compelling evidence of defects and other physical conditions.
  • Counsel to major aerospace industry contractor in the design and construction of launch facilities.
Part 3
  • Counseled clients in pursuing recovery and defending against delays, defects, insurance and other indemnity claims in the road building industry, high-rise condominium industry, industrial and power facilities, water resources facilities, and other major civil and institutional projects.
  • Represented the construction manager for the $375 million Orange County Convention Center and served as Assistant Counsel to the Greater Orlando Aviation Authority for major development activity for a billion-dollar expansion.
  • Represented themed attractions owners and contractors.
  • Advised clients in the project delivery decision-making process and contract negotiations for major facilities including convention centers, resort hotels, industrial/manufacturing plants, roadway/utility infrastructure and high-rise office buildings.
