Deerfield PlantationPOA v. Deertrack Inc., and the U. S. Army Corps of Engineers, et al. — This is a citizens suit filed under the Clean Water Act in which a homeowner''s association is challenging a jurisdictional determination made by the Corps of Engineers. This is one of the first of several similar cases, filed by environmental advocacy groups, who are concerned about whether the Corps is properly applying the U. S. Supreme Court''s decision in the Rapanos case. This is a new use of the citizen''s suit provision in the Clean Water Act in S. C. , but is becoming more prevalent as a tool to stop/slow development.
Patricia Tenney v. State of South Carolina — This is an action to quiet title against the State of South Carolina. Plaintiff Tenney is the record owner of a 15 acre coastal island located on the Cooper River, Beaufort County, S. C. The State of S. C. has asserted presumptive title to all coastal islands based on the State''s ownership of the tidal wetlands surrounding the coastal islands. The Court of Common Pleas, Beaufort County, held that the State did not have presumptive title of Tenney''s property and the State has filed an appeal with the S. C. Court of Appeals.
