    Case History

Victory granted in Uniform Commercial Code dispute on behalf of firm client — Margaret Diamond and Larry Feldman won the reversal of a judgment against a national bank and credit corporation in a hard-fought case decided by the Louisiana Court of Appeal, Second Circuit, on June 27, 2014. The Court relied heavily on the firm’s briefing of the facts that led to the trial court’s judgment against McGlinchey's client and agreed that the lower court had committed several legal errors in finding the bank responsible for the plaintiff-bank customer’s loss. The Second Circuit’s decision clarifies Louisiana banking law and makes clear that Louisiana’s interpretation of the Uniform Commercial Code is in line with nationwide practice.
