Julianna Tabastajewa is a partner in Gowlings' Moscow office. Her practice focuses on intellectual property protection and litigation, pharmaceutical law, competition law, media law, and franchising. She also has extensive experience in domestic litigations and arbitrations in Russia.
Throughout her career, Julianna has represented major Russian and international companies in sophisticated copyright, trade-mark, patent, and domain disputes, including several successful precedent cases for Quelle AG, Volkswagen AG, Audi AG, Champagne Cristal Loius Roederer etc.
Julianna has contributed significantly to new domain regulations in the Russian Federation and has written extensively on the subject. She is also actively involved in intellectual property legislation development initiatives in Russia as an authority of the Anti-piracy Committee of the State Duma (legislative assembly) of the Russian Federation. She is currently working in the Russian Franchising Association on the changes to the Franchising laws. Julianna also advises media, pharmaceutical, and medical device companies on related issues in Russia.
Prior to joining the firm, Julianna served as head of the intellectual property and information technology department in the Moscow office of a Munich-based international law firm for over 9 years and in the Moscow office of a D.C.-based international firm for over four years.
Julianna has authored over 70 publications on IP issues.
Successfully represented French elite champagne house Champagne Louis Roederer in a dispute with the Rospatent (Russian Agency for Patent and Trademarks) and the Russian Federal state-owned enterprise Soyuzplodoimport on providing legal protection for the combined trade-mark Cristal Louis Roederer (champagne label) in Russia. The court has reversed the decision of the Russian Chamber for Patent Disputes to cancel the legal protection of the "Cristal" trade-mark in Russia.
Advised a major international company selling clothes and household products by mail, on intellectual property issues, including successfully representing the company in a number of litigation cases relating to the disputes in connection with infringement of the company's trade-mark rights in the Internet domain names, and with regard to the acquisition of the trade-mark portfolio in the course of acquisition of another international company business.
Legal advice to a well-known American producer of woman's and children's footwear (under PayLess trade-mark), in connection with the opening of a franchising network in Russia.
Successfully represented Volkswagen AG in a complex cyber squatting dispute in connection with the infringement of VW trade-marks in the domain vw.ru.
Successfully represented Volkswagen AG in a case relating to trade-mark infringement in advertising and obtained a precedent judgment before the Supreme Arbitrage Court of the Russian Federation.
Represented Nestlé in connection with trade-mark protection against a major competitor and advised on copyright issues with regard to the purchase of the Russian company Bystrov.
