Counsel to LifeTime Capital Receiver — Since 2004, has acted as counsel to the Federal Court appointed receiver of LifeTime Capital, Inc. LifeTime Capital was a viatical and life settlement company that raised approximately $100M from more than 3,000 investors. The company was placed in receivership after its principal was indicted on numerous fraud charges and the investments purchased by investors were in danger of lapsing given a lack of funds within the company. Numerous actions were prosecuted and the portfolio of insurance policies ultimately sold for the benefit of defrauded investors.
Counsel to The Dayton Foundation — General counsel to The Dayton Foundation, the Dayton area's community foundation which holds and administers approximately $380M in local charitable assets. Representation includes occasional litigation work in addition to philanthropic, corporate and estate planning matters.
Junk vs. Conrad et al. — Defended family and family business against claims of alleged minority owner. The Plaintiff alleged ownership in a spring water company and breaches of fiduciary duties relating to the termination of his involvement with the business.
U.S. Inspection Services vs. NL Engineered Solutions, LLC etc. — Represented a manufacturer of semi-tractor trailers that had been compelled to issue a recall of hundreds of trailers due to the failure of a critical component. The matter involved six parties in three cases in three states and claims of breach of warranty, negligence, fraud and others.
