I have practiced in the Firm's Insolvency & Creditor Rights Section for over twenty years. I focus on representing companies, creditors, and court-appointed committees in Chapter 11 bankruptcy proceedings throughout Texas and elsewhere.  I have extensive experience in the restructuring of health care businesses and complex real estate investments.  I also frequently represent parties interested in using the bankruptcy process for M&A transactions.

Case History

Dental Practice Managment Company — Represented a Texas based dental practice management company in its Chapter 11 Case facing complex regulatory and financial issues.  Led the successful negotiation of the sale of operating business and settlement with regulatory officials, resulting in a confirmed plan of reorganization.
Oklahoma Hospital — Represented financially distressed independent hospital in central Oklahoma in its Chapter 11 Bankruptcy Case.  Secured a priming debtor in possession financing facility for Debtor and let successful sale process to transfer hospital operations to regional healthcare operator.
Steak & Ale/Bennigan's Chapter 7 Trustee — Represented the Chapter 7 trustee in the Chapter 7 filing of the affiliated corporate owners Steak & Ale and Bennigan's restaurants across the country.  Firm was called upon with hours of the Trustee's notice of appointment to address on an emergency basis the overnight shut down of approximately 220 restaurant locations owned or controlled by over 48 entities.  Firm's successful navigated the emergency issues regarding leases, utilities, liquor control,  health and safety issues.  Firm further developed and implemented procedures that led to the resolution of PACA and 503(b)(9) claims without extensive litigation.  In addition, Firm assisted the trustee in resolving numerous claims against related parties  as well as garden variety avoidance actions.
FirstPlus Financial — Firm's originally represented the official unsecured creditor's committee in Chapter 11 filing of FirstPlus Financial, Inc. and successfully negotiated a confirmed plan of reorganization for the company with multiple secured parties and publically traded parent company..  Post confirmation, the firm represented the plan trustee in connection with the disposition of multiple business, sale of financial and non financial assets and resolution of complex multi-state class action litigation concerning the loan practices of the debtor.   Firm also handled hundreds of claim objections and post confirmation avoidance action in connection with representing the plan trustee.
