Jennifer Spencer is a Partner in the Litigation group. She practices general commercial litigation, with experience spanning many industries and areas of practice including complex commercial disputes, product liability, agriculture, regulatory matters, Aboriginal law, and administrative law. Jennifer has expertise with corporate governance issues, including directors' duties, and related matters in the corporate, Aboriginal and not-for-profit sectors. She also has experience with the regulatory environment and dispute resolution around food labelling and natural products as well as product safety, recalls and consumer protection issues.
Jennifer has appeared in all levels of courts in British Columbia, the Federal Court, and before various provincial and federal administrative tribunals. She is also experienced with judicial review and appeals from government decisions. Before practising law, she worked in management at an internationally renowned company in the British Columbia tourism and hospitality sector.
Litigation: Jennifer enjoys a wide range of briefs in her practice, many of which involve technical and scientific or raise public policy considerations. She is experienced working with multidisciplinary teams on risk-management issues for corporate clients in Canada and with multi-jurisdictional teams for clients outside of Canada. Jennifer has worked with administrative decision-makers and other clients providing advice on appeals and judicial reviews in both the public sector, with commodities boards and in the forensic mental health field. She also has had experience with the investigation and drafting of administrative appeal decisions for a public body.
Jennifer advises a number of public companies and societies, including clients in the agriculture, construction, manufacturing, banking, financial services, technological, Aboriginal and charitable sectors, with respect to their regulatory environments. She served as co-counsel amicus curiae, providing a legal brief to the court on the constitutional issues arising from an application to close the court to the public in a Mutual Legal Assistance Treaty matter. Jennifer also participated as co-counsel in an extensive public inquiry on law enforcement related issues.
Governance Matters, including Aboriginal Governance: Jennifer has worked with a number of organizations, including corporations, pension administrators, not-for profits and First Nations organizations on governance policy and risk management issues. She also works with First Nations and industry on opinion and risk management work, including governance issues, consultation and accommodation matters, and land and natural resource use.
