Courtney Gilmer is a bankruptcy and creditors' rights shareholder in the Nashville office of Baker Donelson. Representative Matters
  • Assisted as Committee Counsel for the Unsecured Creditors Committee in the Chapter 11 proceedings of a national pediatric dental management company pending in the U.S. Bankruptcy Court for the Middle District of Tennessee.
  • Serve as counsel to lender for litigation in bankruptcy court and state court involving a variety of claims, including alleged violations of FDCPA, RESPA and TILA.
  • Represented nearly 60 commercial landlords in bankruptcy of national jewelry and home goods retailer Service Merchandise Company, Inc.; subsequent representation of more than 50 defendants in avoidance and claim litigation.  
  • Represented approximately 30 preference defendants in bankruptcy of Murray, Inc., a national lawn and garden equipment manufacturer.  
  • Served as counsel for operating trustees in Chapter 11 proceedings.
  • Represent secured lenders in workouts and out-of-court restructurings, including negotiation and drafting of forbearance agreements.
  • Regular representation of creditors in avoidance and claim litigation in various jurisdictions.
  • Regular representation of secured lenders and commercial landlords in contested matters, including stay relief and related proceedings.
