What do you focus on?
Currently, my focus is on three principal areas: environmental due diligence in transactions, compliance with environmental regulations and remediation of contaminated property.
Environmental Due Diligence
I have represented buyers, sellers, borrowers, lenders, investors, syndicators and underwriters in myriad transactions involving the transfer of real properties and/or businesses located throughout the United States and in other countries. I focus not only on the “all appropriate inquiry” requirements for certain defenses under the federal Superfund liability scheme, but also on development of practical solutions to identified concerns.
Compliance with Regulations
Federal, state and local environmental requirements are continually evolving, and I work with manufacturers, developers, municipalities and other regulated entities to ensure compliance with ever changing regulations that can impose significant penalties for violation and require modifications to operations, training and recordkeeping.
Remediation of Property
I represent clients who have properties subject to brownfield, federal and state Superfund and spill remediation programs, ensuring compliance with the program requirements, appropriate allocation of costs among responsible parties and return of the property to an appropriate use.
