Board of County Commissioners of Boulder County I represented the church in a lawsuit against Boulder County under the Religious Land Use and Institutionalized Persons Act of 2000.  Following a jury verdict finding that the county had violated three separate provisions of the act, the court ordered the county to approve a special use application to expand the church facilities and awarded attorneys'''' fees in excess of $1 million.  The county''''s appeal is pending in the Tenth Circuit, and it has expressed the intention of pursuing its constitutional challenge to RLUIPA to the Supreme Court.
