Practice Area Overview

Transport law governs all activities of the transport industry.

These activities can be divided into three sectors: land (which includes road, rail and waterway), maritime and air transport.

A contract of carriage is a contract by which a carrier has the duty to transfer goods or carry a person for a price. This transport duty is the main obligation under the contract of carriage.

Depending on the mode of transport, every segment of the transport industry has its own rules. Certain transport sectors are governed by standard model contracts, which are binding when the contracting parties have not signed a written agreement. For example, a standard contract exists for the ‘occasional collective service of public transport’ for road transport.

Among the actors of this sector, freight forwarders play an important role in transport law and their liability is often sought out. Freight forwarders are intermediaries who arrange and execute, under their liability, the carriage of goods, using the mode of transport of their choice, on behalf of a shipper.

Transport law also has an inherent international scope. The rules governing national transport and those governing international transport should be well distinguished. In Europe, the European Commission has enacted specific rules for transport within its borders.

The European Commission has also adopted a white paper to supervise the development of the transport industry in Europe and to create a competitive European transport system.

The main goal of this white paper is to increase urban mobility whilst reducing Europe's dependence on imported oil and cutting carbon emissions by the transport industry.

In France, all transport rules have been merged within the same transport code, called “Code des Transports”. This code compiles sets of rules that were before scattered in eight different codes including the maritime labour law code (“Code du travail maritime”), the civil aviation code (“Code de l’aviation civile”), and the code of maritime trade ports (“Code des ports maritimes”). Codification was carried out without affecting existing legislation.

A transport lawyer must possess full knowledge of transport law and have a general understanding of the economy, in order to draft legal opinions and devise the most appropriate litigation strategies. He or she must also be able to represent and defend the interests of his or her clients before all French (administrative, civil and criminal) and European courts (ICC, ECJ), as well as before the various arbitration bodies.

Le droit des transports a vocation à régir l’ensemble des activités de transport.

Ces activités peuvent se subdiviser en  trois branches différentes : le transport terrestre, regroupant les transports routiers, ferroviaires et fluviaux, le transport aérien et le transport maritime.

Le contrat de transport est juridiquement le contrat par lequel, moyennant paiement d’un prix, un prestataire, le transporteur, s’oblige à déplacer un bien ou une personne.  L’obligation de déplacement est l’obligation caractéristique et principale de ce contrat.

Suivant les différents modes de transport, il existe des règles propres à chaque contrat de transport. Certains types de transport sont d’ailleurs encadrés par des contrats types comme par exemple les services occasionnels collectifs de transports intérieurs publics routiers de personnes. Ces contrats types s’appliquent en l’absence de convention écrite entre les parties.

Parmi les acteurs de ce domaine, les commissionnaires de transport jouent également un rôle important dans le droit des transports et leur responsabilité est souvent mise en cause. Les commissionnaires de transport sont les personnes qui organisent et font exécuter, sous leur responsabilité et leur propre nom, un transport de marchandises selon les modes de leur choix pour le compte d’un commettant.

Le droit des transports a également par nature une vocation internationale. Une distinction textuelle existe pour les transports internes et les transports internationaux. En Europe, il existe également des règles propres pour les transports intracommunautaires.

La Commission Européenne a d’ailleurs adopté un Livre Blanc pour encadrer le développement des transports en Europe afin de créer un système de transport compétitif.

L’objectif de ce livre blanc est d’augmenter la mobilité urbaine tout en réduisant la dépendance de l’Europe envers les importations de pétrole et de diminuer de façon significative les émissions de carbone dans les transports.

En France, le Code des transports regroupe l’ensemble des lois et ordonnances en matière de transports et regroupe les dispositions de huit Codes dont le Code du travail maritime, le Code de l’aviation civile, le Code des ports maritimes. La codification a été effectuée à droit constant sans modification des règles de base.

L’avocat spécialisé en droit des transports doit donc conseiller et représenter son client dans des domaines très divers, en contentieux comme en conseil. Il doit également être compétent pour représenter et défendre les intérêts de ses clients devant toutes les juridictions françaises (administratives, civiles et pénales) et communautaires (TPI, CJUE), ainsi que devant les différents organismes d’arbitrages.
